Advertising Terms and Refund Policy

These Advertising Terms apply to free and paid listings submitted to FindLocal SA and form part of our Terms and Conditions. Advertisers must accept both documents before starting a paid checkout.

1. Advertiser responsibility

You confirm that you are authorised to advertise the relevant business, product, property, vehicle, vacancy, event or service. Every description, price, image, contact detail, ownership claim, licence, qualification, permission and product or service claim must be accurate, current, honest, lawful, complete and reasonably verifiable.

You must promptly update or remove an advertisement when information changes, an item is sold, a service ends or a claim is no longer accurate. FindLocal SA may request reasonable supporting evidence.

2. Prohibited advertisements

Escort services and all advertising connected to the sex industry are prohibited. This includes prostitution-related services, sexual services, adult entertainment services, erotic massage, companionship offered or reasonably understood as a sexual service, and similar content regardless of the wording, imagery or category used.

You may not advertise illegal, stolen, unsafe, counterfeit or restricted items; fraudulent opportunities; misleading claims; infringing content; hateful or discriminatory material; defamatory content; or anything that creates an unreasonable risk to users or the platform.

FindLocal SA may reject or delete prohibited advertisements, suspend the associated account and preserve relevant records where reasonably necessary for safety, compliance or dispute purposes. Removal for breach does not create a right to a refund, except where applicable law requires otherwise.

3. Images and intellectual property

You must own or have permission to use every image, logo and other item submitted. Images must accurately represent the advertisement and must not expose unnecessary personal information or contain prohibited sexual or unlawful content.

4. Packages, prices and duration

The package price, features, image limits, town coverage and display duration shown when you submit an advertisement apply to that order. Free and paid packages may have different visibility and placement. Search position and customer response are not guaranteed.

5. Acceptance before payment

Before a paid checkout can begin, the advertiser must actively confirm that the advertisement is accurate, honest, lawful and verifiable and accept the Terms and Conditions, these Advertising Terms and the refund policy. The confirmation box is intentionally left unchecked and must be selected by the advertiser.

6. Payment and activation

Paid advertisements remain payment-pending until PayFast confirms a successful transaction. Successful payment places an advertisement into moderation; it does not guarantee approval. Never repeat a payment unless the first transaction is confirmed as unsuccessful.

7. Review and approval

FindLocal SA may approve, reject, suspend, delete or request changes to an advertisement. Approval does not constitute independent verification, certification, recommendation or endorsement of the advertiser, product or service.

8. Direct dealings

FindLocal SA provides advertising space and directory functionality only. Buyers, sellers and advertisers deal directly with one another. FindLocal SA and its owner do not facilitate, receive, hold, transfer or refund money exchanged directly between users and are not parties to their transactions or disputes.

9. Cancellations and refunds

Contact us promptly if you made a duplicate payment, paid in error or need to cancel before publication. Once an advertisement has been approved and made live, the advertising service has commenced and no refund, whether in full or in part, will be provided because the advertiser changes their mind, receives no enquiries, sells an item, closes a business or requests early removal.

A refund or other remedy may nevertheless be provided where required by applicable South African law, where a duplicate payment is confirmed, or where FindLocal SA is unable to provide the purchased advertising service for reasons attributable to FindLocal SA. Nothing in these terms limits a non-excludable consumer right.

10. No guaranteed results

FindLocal SA does not guarantee approval, enquiries, leads, sales, revenue, search rankings or any particular commercial result.

11. Liability and indemnity

To the fullest extent permitted by South African law, FindLocal SA and its owner are not liable for advertiser conduct, user-generated content, inaccurate advertisements, failed transactions, fraud by a user, defective or unsafe goods or services, or loss arising from direct dealings between users. Where liability cannot lawfully be excluded, aggregate liability relating to a paid package will, to the extent legally permissible, be limited to the fee paid for that specific package.

To the extent permitted by law, the advertiser indemnifies FindLocal SA and its owner against third-party claims, losses, damages and reasonable legal costs arising from the advertiser's unlawful, false, misleading, defamatory or infringing content; lack of authority to advertise; breach of these terms; or transaction with another user.
