Terms and Conditions

These Terms and Conditions govern access to and use of FindLocal SA, including its public directory, advertiser dashboard, enquiry tools and related services. By accessing or using the platform, creating an account, submitting an advertisement or making a payment, you agree to these Terms and our Advertising Terms.

1. About the platform

FindLocal SA is an online directory and advertising platform that helps users discover local businesses, services and classified advertisements. FindLocal SA, its owner and operators are not the seller, buyer, contractor, employer, agent, broker, representative, escrow provider or payment intermediary in transactions between platform users and advertisers.

2. Eligibility and accounts

You must provide accurate information, keep your login details confidential and notify us if you suspect unauthorised account access. You are responsible for activity performed through your account. A person advertising a business, product, property, vehicle, vacancy, event or service confirms that they have the legal authority and all necessary permissions to do so.

3. Advertiser warranties and responsibility

Advertisers warrant that all submitted information is accurate, current, honest, lawful, complete and reasonably verifiable. This includes descriptions, prices, images, ownership claims, qualifications, licences, availability, contact details and statements about products or services.

Advertisers must correct or remove information that becomes inaccurate, misleading, unavailable or outdated. FindLocal SA may request reasonable supporting evidence. Moderation or publication does not mean that FindLocal SA has independently verified, certified, recommended or endorsed an advertiser, product or service.

4. Prohibited advertisements

Escort services and sex-industry advertising are strictly prohibited. This includes prostitution-related services, sexual services, adult entertainment services, erotic massage, companionship offered or reasonably understood as a sexual service, and any other advertisement connected to the commercial sex industry.

Advertisements for illegal, stolen, unsafe, counterfeit or restricted items; fraudulent opportunities; misleading claims; discriminatory or hateful content; defamatory material; or content that infringes another person's rights are also prohibited. FindLocal SA may reject, suspend or delete prohibited content and may restrict the responsible account. Removal for breach does not create a right to a refund, except where applicable law requires otherwise.

5. Content licence and moderation

Advertisers retain ownership of content they submit and grant FindLocal SA a non-exclusive licence to host, reproduce, format and display that content for operating and promoting the directory. We may review, request changes to, reject, suspend or remove content that breaches these Terms, creates risk or is unsuitable for the platform.

6. Direct dealings between users

Buyers, sellers, advertisers and other users communicate, negotiate and transact directly with one another. Any agreement or transaction is solely between those parties. FindLocal SA and its owner do not facilitate, receive, hold, transfer or refund money exchanged directly between users.

Users must independently verify identities, ownership, condition, legality, qualifications, licences, prices, payment arrangements and product or service claims before proceeding. Any dispute concerning an advertised product, service or transaction must be resolved directly between the relevant buyer, seller, advertiser or service provider.

7. Paid advertising

Paid advertising is subject to our Advertising Terms. PayFast or another independent payment service provider may process advertising-package payments made to FindLocal SA. FindLocal SA does not store full payment-card details.

8. Advertising fees, cancellations and refunds

Before publication begins, FindLocal SA may consider a cancellation, duplicate-payment or payment-error request. Once an advertisement has been approved and made live, the purchased advertising service has commenced and the advertising fee is non-refundable, whether in full or in part, including where the advertiser changes their mind, receives no enquiries, sells an item, closes a business or requests early removal.

A refund or other remedy may nevertheless be provided where required by applicable South African law, where a duplicate payment is confirmed, or where FindLocal SA is unable to provide the purchased advertising service for reasons attributable to FindLocal SA. Nothing in these Terms limits a consumer right that cannot lawfully be excluded.

9. No guaranteed results

FindLocal SA supplies advertising space and directory functionality. We do not guarantee approval, enquiries, leads, sales, revenue, rankings, availability or any particular commercial result.

10. Availability

We aim to keep the platform available and accurate but cannot guarantee uninterrupted or error-free operation. We may maintain, improve, suspend or change features when reasonably necessary.

11. Limitation of liability

To the fullest extent permitted by South African law, FindLocal SA, its owner, operators, employees, contractors and representatives are not liable for user-generated content; advertiser conduct; inaccurate or misleading advertisements; failed transactions; non-payment; fraud by a user; defective, unlawful or unsafe goods or services; personal meetings; or loss arising from direct dealings between users.

FindLocal SA will not be liable for indirect, incidental, special or consequential loss, loss of profit, loss of business, loss of opportunity or reputational damage. Where liability cannot lawfully be excluded, aggregate liability arising from a paid advertising service will, to the extent legally permissible, be limited to the advertising fee paid to FindLocal SA for the specific package giving rise to the claim.

Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded or limited.

12. Advertiser indemnity

To the extent permitted by law, the advertiser indemnifies FindLocal SA and its owner against third-party claims, losses, damages and reasonable legal costs arising from the advertiser's unlawful, false, misleading, defamatory or infringing content; lack of authority to advertise; breach of these Terms; or transaction with another user. This indemnity does not apply to loss caused by FindLocal SA for which liability cannot lawfully be excluded.

13. Privacy

Our processing of personal information is explained in the Privacy Policy.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. Before commencing formal proceedings, the parties should first attempt to resolve a dispute in good faith.
